1 Definitions
In these Terms and Conditions:
- "ALS" means Australian Language Schools Pty Ltd (CRICOS Provider Code: 02885G)
- "Guarantee" means the visa refund guarantee described in these Terms and Conditions.
- "Student" means the individual enrolled in an eligible course with ALS and named on the COE.
- "COE" means a Confirmation of Enrolment issued by ALS for an offshore enrolment.
- "Visa Application Fee" means the fee paid directly to the Australian Department of Home Affairs for a Subclass 500 Student visa application.
- "Refusal Date" means the date of the formal written notice of visa refusal issued by the Department of Home Affairs.
- "Lodgement" means the act of formally submitting a Subclass 500 visa application to the Department of Home Affairs.
- "Dependents" means any person included in the student's visa application as a secondary applicant.
2 Scope and Applicability
This Guarantee applies exclusively to offshore enrolments, with ALS as the only provider.
It does not apply to:
- Packaged enrolments with other providers.
- Onshore COE enrolments of any course type.
- Any visa application other than the Australian Subclass 500 Student visa.
- Students who have already lodged a visa application prior to registering for this Guarantee.
- Applications lodged after 20 December 2026.
3 Eligibility Criteria
To be eligible for the Guarantee, the Student must satisfy all of the following criteria at the time of visa lodgement:
3.1 Course Requirements
ELICOS: The Student must be enrolled in an ELICOS course of 25 weeks or more. Both paid and complimentary weeks count toward the 25-week minimum.
VET: The Student must be enrolled in two (2) or more BSB-coded VET courses totalling a minimum of 100 weeks. Civil construction courses are excluded from this Guarantee.
3.2 Age
The Student must be 36 years of age or younger on the date of visa lodgement. Date of birth will be verified against the Student's passport.
3.3 No Dependents
The visa application must not include any dependent applicants. Applications that include a partner, child, or any other secondary applicant are not covered by this Guarantee.
3.4 No Adverse Immigration History
The Student must have no adverse immigration history in Australia or any other country, including but not limited to:
- A previous visa refusal, cancellation, or curtailment in any country.
- Removal or deportation from any country.
- Any finding of character concern or criminal conviction in any jurisdiction.
ALS reserves the right to request a statutory declaration regarding immigration history prior to confirming eligibility, or refuse to pay a refund if this becomes apparent afterwards.
3.5 Application and Lodgement Deadlines
- The Student must apply for the Guarantee no later than 30 September 2026.
- The Subclass 500 visa application must be lodged no later than 20 December 2026.
- ALS must be copied on all formal notification of lodgement at the time of submission.
4 How to Register
- The Student (or their authorised agent) must submit a completed Application Form to ALS prior to the application deadline of 30 September 2026.
- ALS will assess eligibility and provide written confirmation of acceptance or rejection within five (5) business days.
- Registration is not confirmed until written acceptance is issued by ALS.
- At the time of lodging the Subclass 500 visa application, the Student must provide ALS with a copy of the visa lodgement receipt or equivalent confirmation from the Department of Home Affairs. Notification must be sent to: [email protected]
5 Refund Amount and Payment Process
5.1 Amount
ALS will refund fifty percent (50%) of the Subclass 500 visa application fee actually paid to the Department of Home Affairs by the Student.
The refund is calculated on the base visa application fee only, excluding any ancillary charges, biometric fees, health examination costs, or other third-party expenses.
Any 3rd party administration fees or bank charges incurred by the payment of this refund will be deducted from the amount or paid by the receiver.
5.2 Payment
The refund will be paid directly to the Student by bank transfer. The refund is entirely separate from, and does not affect, any course fees, enrolment fees, or other amounts owed to or paid to ALS.
5.3 Claiming the Refund
To claim the refund following a visa refusal, the Student must submit the following to ALS within thirty (30) calendar days of the Refusal Date:
- A copy of the formal visa refusal notice issued by the Department of Home Affairs.
- Proof of the visa application fee paid (e.g. receipt or bank statement).
- Completed Refund Claim Form (available from ALS), including bank account details for the refund payment.
ALS will process eligible claims and issue payment within thirty (30) business days of receiving all required documentation.
6 Limitations and Exclusions
- This Guarantee is available to each eligible student once only. Subsequent visa applications by the same student, whether for the same or a different course, are not covered.
- The Guarantee does not cover visa applications that are withdrawn, lapsed, or deemed invalid by the Department of Home Affairs.
- The Guarantee does not apply where the refusal arises from information that was not disclosed to ALS at the time of registration, including any adverse immigration history.
- ALS accepts no liability for any loss, cost, or damage arising from or in connection with the visa refusal, beyond the 50% refund of the visa application fee as described herein.
- The Guarantee does not constitute immigration advice. Students are strongly encouraged to engage a registered migration agent (MARA) for visa application assistance.
- ALS reserves the right to withdraw or modify this Guarantee at any time, provided that any changes do not affect confirmed registrations already accepted in writing.
7 General Provisions
7.1 Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising in connection with this Guarantee will be subject to the exclusive jurisdiction of the courts of Queensland.
7.2 Privacy
Personal information collected in connection with this Guarantee will be handled in accordance with ALS's Privacy Policy and the Privacy Act 1988 (Cth). Information may be shared with the Department of Home Affairs where required for verification purposes.
7.3 Severability
If any provision of these Terms and Conditions is found to be unenforceable, that provision will be severed and the remainder will continue in full force and effect.
7.4 Entire Agreement
These Terms and Conditions, together with the Guarantee Registration Form, constitute the entire agreement between ALS and the Student in respect of this Guarantee and supersede all prior representations and understandings.
